Renowned Tarrant County DWI Defense Lawyer Serving All of Texas

With more than 20 years in the legal industry and a background as a former police lieutenant, Attorney Sloane understands these types of cases better than most Fort Worth DWI attorneys can and brings a rare and invaluable level of credibility to his practice. This area of law is highly technical and complex, involving studies in such fields as anatomy, biology, physiology, toxicology, and chemistry.

As a member of the National College of DUI Defense - which holds a high standard of education, experience, and skill for all members - Attorney Sloane understands this field and is prepared to offer unusually perceptive advice and effective representation.

Consequences of a DWI conviction can include the following:

  • First offense: Up to 180 days in jail, $2,000 in fines, and 90-365 days of license suspension
  • Second offense: Up to 1 year in jail, $4,000 in fines, up to 2 years of license suspension, and mandatory installation of ignition interlock device
  • Third offense: Up to 10 years in jail, $10,000 in fines, and 2 years of license suspension

It is also important to understand the various legal aspects involved in this field of law, including search and seizure laws, due process, issues with evidence, and much more. There are often complications involved in the tests administered to determine a person's level of intoxication.

Attorney Sloane understands these tests and, consequently, the problems that often arise in connection with results. He has been trained in the correct operation of the Intoxilyzer 5000 breath-testing equipment as used by police officers throughout Texas and has even instructed police recruits in the proper administration of field sobriety tests. Because of this in-depth experience, Attorney Sloane is able to quickly recognize problems or evidentiary issues connected with these tests in a DUI case.

How much is too much alcohol?

You could be convicted of DWI in Texas if you are found to be driving with a blood alcohol contact (BAC) of 0.08 percent or higher. If you are a commercial driver, the BAC limit is 0.04 percent. If you are under the age of 21, any trace amount of alcohol in your bloodstream - as low as 0.02 percent - is grounds for a Texas DWI charge.

Types of DWI Charges

DWI Misdemeanor vs. Felony Charges

The majority of people charged with DWIs are charged with misdemeanor DWI. Misdemeanor DWI penalties include fines and possible jail time. You may also have your license suspended for a period of up to one year. In DWI felony offenses, the individual charged could face up to one year in a prison and if significant property damage or injury occurred, you may be required to pay restitution.

Drugged Driving

Texas penal code prohibits drivers from driving while intoxicated. Under the eyes of the law, the term intoxicated means not having normal use of physical and mental abilities. You could have intoxicated from drinking alcohol or ingesting a controlled substance. If you are arrested for driving while drugged, you will be charged under DWI charges but the law will consider it as a prior offense for the purpose of calculating the punishment.

Boating While Intoxicated

If you are one of the many people who enjoy a nice warm day out on the lake with some BBQ and beers, you may be aware that there are strict laws regarding boating while under the influence. Unfortunately, many vacationers renting a boat for the day are unaware of the dangers operating a boat while under the influence. Penalties for boating while intoxicated are similar to DWIs. The first conviction carries a fine of up to $2,000 and up to 180 days jail time.
