Terroristic Threat Explained – Texas Penal Code § 22.07(a)
Pursuant to Texas Penal Code § 22.07(a), a person commits the offense of Terroristic Threat if the person threatens to commit any offense involving violence to any person or property with intent to:
- Cause a reaction of any type to his threat by an official or volunteer agency organized to deal with emergencies;
- Place any person in fear of imminent serious bodily injury;
- Prevent or interrupt the occupation or use of a building, room, place of assembly, place to which the public has access, place of employment or occupation, aircraft, automobile or other form of conveyance, or other public place;
- Cause impairment or interruption of public communications, public transportation, public water, gas, or power supply or other public services;
- Place the public or a substantial group of the public in fear of serious bodily injury; or
- Influence the conduct or activities of a branch or agency of the federal government, the state, or a political subdivision of the state.
Terroristic Threat Punishment Ranges – Texas Penal Code § 22.07(b)-(e)
The punishment range for Terroristic Threat depends on the alleged conduct.
Terroristic Threat is a Class B Misdemeanor, punishable up to six months in jail and a fine up to $2,000, if:
- A person threatens to commit any offense involving violence to any person or property with intent to cause a reaction of any type to his threat by an official or volunteer agency organized to deal with emergencies; or
- A person threatens to commit any offense involving violence to any person or property with intent to place any person in fear of imminent serious bodily injury.

Terroristic Threat is a Class A Misdemeanor, punishable up to one year in jail and a fine up to $4,000, if:
- A person threatens to commit any offense involving violence to a person of the actor’s family or household with intent to place the family or household member in fear of imminent serious bodily injury;
- A person threatens to commit any offense involving violence to a public servant with intent to place the public servant in fear of imminent serious bodily injury; or
- A person threatens to commit any offense involving violence to any person or property with intent to prevent or interrupt the occupation or use of a building, room, place of assembly, place to which the public has access, place of employment or occupation, aircraft, automobile or other form of conveyance, or other public place.

Terroristic Threat is a State-Jail Felony, punishable between six months to two years in a state-jail facility and a fine up to $10,000, if:
- A person threatens to commit any offense involving violence to a peace officer or judge with the intent to place the peace officer or judge in fear of imminent serious bodily injury and the actor knows the person is a peace officer or judge;
- A person threatens to commit any offense involving violence to any person or property with intent to prevent or interrupt the occupation or use of a building, room, place of assembly, place to which the public has access, place of employment or occupation, aircraft, automobile or other form of conveyance, or other public place and the actor causes a pecuniary loss of $1,500 or more to the owner of the building, room, place, or conveyance.

Terroristic Threat is a Third-Degree Felony, punishable between two to ten years in prison and a fine up to $10,000, if:
- A person threatens to commit any offense involving violence to any person or property with intent to cause impairment or interruption of public communications, public transportation, public water, gas, or power supply or other public service;
- A person threatens to commit any offense involving violence to any person or property with intent to place the public or a substantial group of the public in fear of serious bodily injury; or
- A person threatens to commit any offense involving violence to any person or property with intent to influence the conduct or activities of a branch or agency of the federal government, the state, or a political subdivision of the state.
