What is a Texas County Clerk?

The County Clerk serves as the recorder of deeds and other instruments for the county court and the county commissioner court. The county clerk is also responsible for conducting countywide special and general elections and for handling absentee voting. In a misdemeanor criminal case, the County Clerk records and maintains the County Court’s record of all documents in a criminal case. This is especially important if the parties, defense counsel and the prosecutor, disagree about the filing date or validity of various documents.

What does a Texas County Clerk do?

A Texas County Clerk:
  • Serves as the clerk and custodian of records for county courts;
  • Serves as the clerk and custodian of records for commissioner’s court;
  • Serves as the recorder and custodian of public records;
  • Issues marriage licenses; and
  • Serves as the chief elections officer in most counties.
A County Clerk also serves as the district clerk in counties with a population fewer than 8,000 people.

Texas County Clerk Requirements and Qualifications

To be a Texas County Clerk, they must meet the following requirements:
  • U.S. Citizen;
  • Texas resident for at least 12 consecutive months;
  • County resident for at least 6 consecutive months;
  • Registered County voter;
  • At least 18 years old;
  • Not have a felony conviction;
  • Not be mentally incapacity.
Additionally, Texas County Clerk appointees or electees must also complete 20 hours of continuing education annually.
