What is a Third Degree Felony?

A Third Degree Felony is one of the least severe felony offenses in Texas. Common examples of Third Degree felonies include: driving while intoxicated third or more (§49.09), intoxication assault (§49.07), possession of a controlled substance between one to four grams (§481.115), and assault on a public servant (§22.01).

Third Degree Felony Punishment – Prison v. Probation

Pursuant to Texas Penal Code § 12.34, a Third Degree Felony is punishable between two to ten years in prison and a fine up to $10,000. Depending on the alleged offense and a defendant’s criminal history, a defendant may be eligible for community supervision probation. If a sentence is probated, a defendant may be placed on community supervision between two to ten years pursuant to Texas Code of Criminal Procedure Article 42A.053.

Can a Third Degree Felony be Enhanced?

The Third Degree Felony punishment range may be enhanced depending on the type of alleged criminal offense or a defendant’s criminal history. Pursuant to Texas Penal Code § 12.42, a Third Degree Felony punishment range may be increased to that of a Second Degree Felony, two to 20 years, if the defendant had previously been convicted of a felony offense; referred to as the repeat offender enhancement. If the defendant has two previous felony convictions, the defendant qualifies for the habitual offender enhancement, which increases the traditional punishment range to 25 to 99 years, or life in prison.

Can a Third Degree Felony be Reduced to a Misdemeanor?

Unlike a State Jail Felony, there is no legal provision to reduce a Third Degree Felony to a misdemeanor under Texas law. The only way to reduce a Third Degree Felony to a misdemeanor is through negotiations with the State.
