What is a District Clerk?

What is a Texas District Clerk?

A District Clerk is a registrar, recorder, and custodian of all court pleadings, instruments, and papers that are part of any legal action in the district courts. In a felony criminal case, the District Clerk records and maintains the District Court’s record of all documents in a criminal case.

What does a Texas District Clerk do?

A Texas District Clerk:
  • Serves as the clerk and custodian of records for the District Court;
  • Indexes and secures all court records, collects filing fees, and maintains funds held in litigation and awards to minors;
  • Coordinates the jury panel selection process;
  • Processes passport applications; and
  • Manages court registry funds.
In Texas counties with a population of less than 8,000 people, the county clerk will also serve as the district clerk, unless there has been a special election.

Texas District Clerk Requirements and Qualifications

To be a Texas District Clerk, they must meet the following requirements:
  • U.S. Citizen;
  • Texas resident for at least 12 consecutive months;
  • County resident for at least 6 consecutive months;
  • Registered County voter;
  • At least 18 years old;
  • Not have a felony conviction;
  • Not be mentally incapacity.
Additionally, Texas District Clerk appointees or electees must also complete 20 hours of continuing education annually.
