First Offense:


- Fine up to $2,000
- Jail time ranging from 3 to 180 days
- License suspension up to 1 year
- Annual surcharge up to $2,000 for 3 years to retain driver's license

Second Offense:


- Fine up to $4,000
- Jail time ranging from 1 month to 1 year
- License suspension up to 2 years
- Annual surcharge up to $2,000 for 3 years

Third Offense:


- Fine up to $10,000
- Imprisonment ranging from 2 to 10 years
- License suspension up to 2 years
- Annual surcharge up to $2,000 for 3 years

Additional penalties may apply if there was an open alcohol container in the vehicle, a passenger under 15 years old, or if the driver caused an accident resulting in injury or death.
